Our terms and conditions apply to all transactions on this site and we recommend that you read each section carefully. They do not affect your statutory rights as a consumer.

Our terms and conditions apply to the use of this website and by accessing this website and/or placing an order you agree to be bound by the terms and conditions set out below. If you do not agree to be bound by these terms and conditions you may not use or access this website.

Please note that the products featured on our professional website include some products that are only for use or re-sale by healthcare professionals such as pharmacies, GP medical centres and health screeners. By agreeing to our terms and conditions, customers using this website certify that the products purchased that are CE marked for ‘professional use’ are intended for use only by trained healthcare professionals. 

Product Rate and Review
These Terms of Use govern your conduct associated with the Customer Ratings and Review service offered by Personal Diagnostics Ltd. To the extent of any conflict between Personal Diagnostics Ltd’s Privacy Policy and these Terms of Use, these Terms of Use shall control with respect to the Customer Ratings and Review Service.

By submitting any content to Personal Diagnostics Ltd, you represent and warrant that:

  • you are the sole author and owner of the intellectual property rights thereto;
  • all "moral rights" that you may have in such content have been voluntarily waived by you;
  • all content that you post is accurate;
  • you are at least 18 years old;
  • use of the content you supply does not violate these Terms of Use and will not cause injury to any person or entity.

You further agree and warrant that you shall not submit any content:

  • that is known by you to be false, inaccurate or misleading
  • that infringes any third party's copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy;
  • that violates any law, statute, ordinance or regulation (including, but not limited to, those governing export control, consumer protection, unfair competition, anti-discrimination or false advertising);
  • that is, or may reasonably be considered to be, defamatory, libelous, hateful, racially or religiously biased or offensive, unlawfully threatening or unlawfully harassing to any individual, partnership or corporation;
  • for which you were compensated or granted any consideration by any third party;
  • that includes any information that references other websites, addresses, email addresses, contact information or phone numbers;
  • that contains any computer viruses, worms or other potentially damaging computer programs or files.

You agree to indemnify and hold Personal Diagnostics Ltd (and its officers, directors, agents, subsidiaries, joint ventures, employees and third-party service providers), harmless from all claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown including reasonable attorneys' fees, arising out of a breach of your representations and warranties set forth above, or your violation of any law or the rights of a third party.

For any content that you submit, you grant Personal Diagnostics Ltd a perpetual, irrevocable, royalty-free, transferable right and license to use, copy, modify, delete in its entirety, adapt, publish, translate, create derivative works from and/or sell and/or distribute such content and/or incorporate such content into any form, medium or technology throughout the world without compensation to you.

All content that you submit may be used at Personal Diagnostics Ltd sole discretion. Personal Diagnostics Ltd reserves the right to change, condense or delete any content on Personal Diagnostics website that Personal Diagnostics Ltd deems, in its sole discretion, to violate the content guidelines or any other provision of these Terms of Use. Personal Diagnostics Ltd does not guarantee that you will have any recourse through Personal Diagnostics Ltd to edit or delete any content you have submitted. Ratings and written comments are generally posted within two to four business days. However, Personal Diagnostics Ltd reserves the right to remove or to refuse to post any submission for any reason. You acknowledge that you, not Personal Diagnostics Ltd, are responsible for the contents of your submission. None of the content that you submit shall be subject to any obligation of confidence on the part of Personal Diagnostics Ltd, its agents, subsidiaries, affiliates, partners or third party service providers and their respective directors, officers and employees.

By submitting your email address in connection with your rating and review, you agree that Personal Diagnostics Ltd and its third party service providers may use your email address to contact you about the status of your review and other administrative purposes

Placing an order and delivery
You can order products displayed on this website on-line or by phone.

We accept orders from the countries indicated in the website order form. The website will show the options for delivery and calculate postage/courier costs from the number of products selected and the destination country once you have entered your postal address. Delivery can be made to any address provide that the address at which your payment card is registered is also present on your order. We do not deliver to Post Office (P.O.) boxes or shipping agent addresses.

On acceptance of your order and receipt of your credit or debit card payment you will receive an order confirmation notice by email to the address given on your order form.

Orders are generally dispatched by either Royal Mail post or by Courier. You will be given the choices available for your country at the checkout.

All orders received during the working week, Monday to Friday will be dispatched within 24 hours provided that the products ordered are in stock. We aim to deliver UK orders the day following your order, but for Royal Mail First Class post please allow up to 5 working days for delivery within the UK, and up to 7 days for international deliveries. If you require a faster delivery service please select the courier option on the order form, which guarantees next day delivery in the UK.

Our couriers require a signature so please specify an address where someone will be able to sign for your goods if you choose this service.
 
We reserve the right to change delivery methods if circumstances require it and to send your order in multiple batches if stock levels dictate.

Whilst every reasonable effort shall be made to keep to any delivery date, time of delivery shall not be of the essence and Personal Diagnostics Ltd shall not be liable for any losses, costs, damages or expenses incurred by the customer or any other person or company arising directly or indirectly out of any failure to meet any estimated delivery date. The risk in the goods shall pass from the company to the customer upon delivery of such goods to the customer.

On receipt the products supplied should be stored within the temperature range indicated on the outer packaging. All products supplied have a limited shelf life and it is the customer’s responsibility to ensure that the test is used before the expiry date indicated on the outer packaging.

For your privacy all orders are shipped in plain outer covers with no indication of product type, or any other description of the product. Please note that our return address will appear on the label as this is a postal service requirement.

Returns Policy
If you need to return a product purchased from us we will offer you an exchange or refund within 7 days of receiving your order. The product must be unused and returned to us in a resalable state within their original box, together with packing and accessories. Refunds will be made to the credit or debit card used to purchase the goods in accordance with these terms and conditions. We reserve the right to apply a re-stocking fee of up to 10% of the order value to cover administrative costs and merchant service fees incurred.

If goods are returned to us because they are proven to be faulty, we will include with your refund the postage that you were charged when purchasing the goods and the postage you paid when returning the item to us.

If you are returning goods because they are unsuitable, we shall only refund the cost of the returned goods. Please note that we are unable to accept returns of NAQI Diabetic Creams, Lotions or Soaps if the seal around the tube or bottle has been broken as these cannot be re-sold for hygiene reasons. 

Before returning any goods you must obtain authorisation from us. You can obtain authorisation by emailing your request to  info@personaldiagnostics.co.uk. Please indicate in your email the reason why the goods are being returned. If you believe a test kit is faulty please supply a digital photograph of your test result with a description of the problem so we have a record of the problem.

If for any reason your order fails to arrive we will ask the Royal Mail or Courier to investigate. The Royal Mail does not consider a parcel 'lost in the post' until 15 working days have passed since despatch. After this time we will send you a form to complete and sign to confirm that you did not receive your order, and on receipt we will send a replacement free of charge. We will use the information you provide to reclaim the cost of the order lost in the post from the Royal Mail and they may contact you in this regard as part of their investigation. If you need your order delivered within a guaranteed time period we strongly recommend selecting delivery by courier at the time that you place your order as we cannot accept responsibility for delays in the postal service that are outside of our control.

All returned goods must be accompanied by the original delivery/invoice note supplied with the goods. All goods being returned must be safely and securely packaged to avoid damage in transit. We will not accept any goods for refund if they have been damaged in transit. We strongly recommend when returning goods to us that you use special or recorded delivery as we are unable to refund goods that are lost in the post. All goods shall remain your responsibility until we receive them.

Payment
Personal Diagnostics accepts payment by Visa, MasterCard, American Express, Switch, Maestro and Delta cards. All product prices and delivery charges are shown in UK pounds Sterling. Your payment card company will perform any currency conversion. VAT will be charged at the appropriate rate for orders within the UK and European Union.

If your delivery address is within the UK you may also pay by cheque. Cheques must be made payable to Personal Diagnostics Limited and have your cheque guarantee card information noted on the reverse. If you wish to pay by cheque please email us at  info@personaldiagnostics.co.uk for instructions on how to place your order.  We will despatch your order once your cheque has cleared so please allow an additional 3 days delivery time.

If we have insufficient stock to deliver the goods you have ordered we will notify you as soon as possible and you will be advised about an expected delivery date or have the option to cancel. If you opt to cancel your order any sum debited from your credit card will be re-credited to your account and we will notify you by email at the address given by you in your order form. The refund will be made as soon as possible and in any event within 30 days of your order. Personal Diagnostics will not be obliged to offer any additional compensation for disappointment suffered.

Liability
Except for death and personal injury due to our negligence or that of our employees, we shall not in any circumstances be liable, whether in contract or tort, to you for any direct, indirect or consequential loss or damage arising from the sale or use of our goods including without limitation loss of profits, damage to property or loss of contracts. In all cases our entire liability shall be limited to damages which shall not exceed the price paid for the goods in respect of which the claim has arisen.

We do not accept any responsibility for any amendments or changes we may make to the information contained in our website and we reserve the right to alter these terms and conditions or the information contained in this website at any time. Any changes to these terms and conditions shall be highlighted and all purchases made from the date of the amendments, shall be subject to the replacement terms and conditions.
 
You shall be responsible for reading and understanding these terms and conditions. We shall not be liable to any person for any loss or damage whatsoever which may arise from the use of any information contained in any of the materials on this website.

We shall not be responsible for any inaccurate results obtained when using any of our testing kits. We recommend a retest in all cases (positive or negative result) by a healthcare professional.
 
General Terms
These terms and conditions and all transactions relating to this website are governed by English law and any disputes will be decided only by the courts of England. We do not accept amendments to these terms and conditions.

These terms and conditions only cover the Personal Diagnostics website. Any other websites that are linked to from this site are governed by their own terms and conditions. We accept no responsibility or liability for the content or operation of websites that are not under our control. We are required by law to tell you that sales can be concluded in English only and that no public filing requirements apply.

Personal Diagnostics Limited own the copyright, trademarks and other intellectual property rights for all material and content on this website, which you may use, download, copy, publish, transmit or otherwise make available by any other means only for your own personal, non–commercial use. Any other use or reproduction of the material or content is strictly prohibited.

We may change or withdraw any part of our website, or may refuse you access to the website at any time if we consider it necessary.
